General Terms and Conditions for Project Creators

1. Preliminary Note, Validity

The following General Terms and Conditions (GTC) apply to all services offered by I Believe In You AG (hereinafter "I Believe In You") to project creators. By using the services of I Believe In You, project creators agree to these GTC. I Believe In You operates the platform www.ibelieveinyou.ch, where natural and legal persons can present sports projects and receive financial support. Project creators must be natural or legal persons with the legal capacity to act. Minors require the written consent of their legal representative. These GTC apply regardless of whether the services are used via www.ibelieveinyou.ch or in any other way.

2. Scope of Services

I Believe In You provides a crowdfunding platform on which project creators can create and promote their own projects. I Believe In You reviews submitted projects before publication. The project creators are solely responsible for the content, implementation, and any rewards (counter-performance). There is no guarantee for the success of the financing or the implementation of the projects. I Believe In You handles the collection of the pledged amounts. In addition to crowdfunding, "I Believe In You" also offers sponsored runs. Fixed amounts pledged in the context of a sponsored run are paid out immediately by I Believe In You. Variable amounts, which depend, for example, on the number of points collected, laps completed, or similar success metrics, are only paid out after the project is completed and the results have been entered.

3. Commissions, Fees, Payout

Upon successful financing of a crowdfunding project (reaching or exceeding the project budget), project creators receive 88% of the total amount. 8% is used to cover platform, consulting, and processing costs, and 4% covers transaction fees. For sponsored runs, the commission is a flat rate of 8% on all contributions received, of which 4% is used to cover transaction fees. Payouts to project creators are made immediately for fixed amounts (flat rates) or after the project ends for variable amounts (e.g., per point or lap). Payouts are made on an ongoing basis after the campaign ends, but no later than 60 days after project completion. Discrepancies may occur if:

Credit cards cannot be charged;
Pledged amounts are not received;
Other reasons exist for which I Believe In You is not responsible.

Unpaid amounts become the risk of the project creator starting from the first unsuccessful payment reminder. If the project goal is not reached, all obligations between project creators and supporters are voided. Supporters are under no legal obligation to pay. Supporting a project is a voluntary donation. If a supporter refuses to pay despite a payment reminder, this money cannot be legally enforced.

5. Obligations of Project Creators

Project creators must be of legal age or present the consent of their legal representative. Proof of identity must be provided upon request. Received funds must be used for the specified purpose. Project creators guarantee that they hold all rights to the submitted content and do not violate the rights of third parties. They grant I Believe In You the right of use to promote their content (texts, images, videos, name). Project creators undertake:

Not to distribute illegal content (e.g., racist, pornographic);
Not to upload viruses or malware;
To comply with the regulations of Swiss Olympic/Swiss Sport Integrity;
Not to infringe upon the rights of the IOC;
Not to engage in self-support or sham support.

Violations will lead to the refund of funds to supporters and the assumption of transaction costs by the project creator.

6. Project Launch, Communication, and Project Progress

Active and targeted communication by project creators is essential for the successful completion of a crowdfunding project. If a project reaches less than 5% of the defined target amount within the first seven days of going live on the platform, “I Believe In You” reserves the right to contact the project organizers and request an update on the future course of communication as well as the planned measures. If the project organizers cannot present any concrete planned measures or fail to respond within a reasonable timeframe, the platform reserves the right, in individual cases, to terminate the project prematurely and remove it from the platform.

1. Preliminary Note, Validity

By using the services of "I Believe In You," the following conditions apply. "I Believe In You" operates the website ibelieveinyou.ch, which enables natural and legal persons to present or financially support sports projects. Providers of projects are hereinafter referred to as "Project Creators," and persons who support a project are referred to as "Supporters." Supporters must be natural or legal persons with full legal capacity. These GTC apply within the framework of the contractual relationship with "I Believe In You" and when using ibelieveinyou.ch.

2. Scope of Services

"I Believe In You" operates the website ibelieveinyou.ch, where supporters can discover and financially support sports projects. These projects are created by the project creators. The project creators are solely responsible for their content, offered rewards, and implementation. Copyright and usage rights remain with the project creators. "I Believe In You" assumes no guarantee for the successful financing or realization of the projects.

3. Relationship between Project Creators and Supporters

"I Believe In You" acts exclusively as an intermediary between project creators and supporters and handles the collection of funds for the project creators. Claims between project creators and supporters must be settled between them. Support contributions are fundamentally understood as donations. Project creators are obliged to let supporters participate in the project's progress. Supporters receive no say in the management of the projects. Project creators undertake to implement their project within a reasonable period after successful financing and to inform supporters regularly about the status.

4. Use, Registration, and Payment

To support a project, personal details such as first name, last name, address, date of birth, email, and telephone number are mandatory. This data is collected for billing and the potential shipping of rewards, as well as to ensure that supporters are eligible to provide support (minimum age: 12). Supporters can remain anonymous upon request but will then waive any rewards. Upon request by "I Believe In You," supporters must identify themselves within the framework of applicable anti-money laundering regulations. Payment becomes due once the project financing is secured (with the exception of fixed amounts for sponsored runs). Payments are made via invoice, TWINT, or credit card and must be settled within 14 days. If the project goal is not reached, all obligations are voided, and no costs are incurred by the supporters.

5. Data Protection / Disclosure of Data

"I Believe In You" stores and processes personal data confidentially for the purpose of providing services. After successful financing, the information of the supporters, including their contact details (name, first name, email), is passed on to the project creators unless an express anonymity agreement exists. The display names of the supporters are visible to all users on ibelieveinyou.ch at all times. If rewards are claimed that require further data (e.g., shipping address), additional information will be forwarded to the project creators. 6. Liability

Liability of "I Believe In You" exists only in cases of intent and gross negligence. The platform assumes no responsibility for the timeliness, accuracy, completeness, or use of the information provided. Liability for technical malfunctions or failures is excluded. "I Believe In You" is not liable for the content of external links but takes reasonable measures to remove illegal references. "I Believe In You" reserves the right to change projects or suspend publication at any time.
